Terms of Service

Just JunkN is a product of Problem SolvD Systems, LLC ("Problem SolvD", "we", "us"). These terms are an agreement between Problem SolvD Systems, LLC and the business that signs up for Just JunkN ("you"). By starting a trial or using the app, you agree to them on behalf of your business, and you confirm you're allowed to do that.

The service

Just JunkN is software for running a junk removal business. Features depend on your plan. We may add, change, or remove features over time, and we'll give account owners reasonable notice before removing a major feature you pay for.

Your account and team

• Keep sign-in details private and tell us if you think your account was used without permission.
• You're responsible for the people you invite and what they do in your account, and for setting their roles and permissions.
• Your plan includes a number of users. Extra users are billed at your plan's rate.

Free trial and billing

• New accounts get a 14-day free trial. No card is needed to start.
• To keep using the app after the trial, choose a plan and add a payment method. Subscriptions are billed monthly in advance through Stripe and renew until canceled.
• You can change plans or cancel from your account. Plan changes show their effect on your bill before you confirm them, and cancellations take effect at the end of the billing period. Fees already paid aren't refunded unless the law requires it.
• If a payment fails, you'll have 7 days to fix it before the account is paused. Your data is kept while the account is paused.
• We may change prices with at least 30 days' notice to account owners.
• Prices don't include taxes, which you pay where they apply. Text messaging carrier fees may apply.

Your data

You own the information you and your team put in Just JunkN. You give us permission to store, process, and transmit it only to provide and improve the service for you. You can export your customer list at any time. After you close your account, we delete your data within a reasonable time, as described in our Privacy Policy.

Your responsibilities

You agree to use Just JunkN lawfully. In particular, you're responsible for:

• Consent to message: getting your customers' permission before texting or emailing them, especially for marketing, and honoring opt-outs. This includes the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and similar laws.
• Call recording: following the laws where you and your callers are if you turn on call recording, including any required notice or consent.
• Employee location: telling your employees, and getting any consent the law requires, before turning on employee locations.
• Your prices, terms, and documents: the estimates, contracts, and terms you send to your customers.

Don't use Just JunkN to send spam, harass anyone, break the law, upload harmful code, try to get into other companies' accounts, or interfere with the service.

Texting Terms

Junk removal companies use Just JunkN to send text messages to their customers and employees.

• What you'll receive: messages from the company you do business with, such as appointment confirmations and reminders, "on the way" notices, estimates, invoices, receipts, and, only if you separately agreed, offers and updates. Employees may receive sign-in codes and work notices.
• Frequency: message frequency varies with your appointments and account activity.
• Cost: message and data rates may apply.
• To stop: reply STOP to any message and you'll stop getting texts from that number.

• Consent to receive texts isn't required to buy goods or services.
• Wireless carriers aren't liable for delayed or undelivered messages.
• Your phone number and texting consent are never sold or shared for marketing. See our Privacy Policy.

Online payments

Customer payments through Just JunkN are processed by Stripe. To accept them, you agree to Stripe's terms, including the Stripe Connected Account Agreement. Payouts, refunds, and disputes are handled through your Stripe account. We aren't a bank or payment processor.

Other services

Just JunkN works with services run by others, such as Stripe, Twilio, SendGrid, and Google Maps. Their terms apply to your use of them, and we aren't responsible for their availability.

Availability and support

We work to keep Just JunkN running and back it up nightly, but we can't promise it will always be available or error-free. We may pause the service briefly for maintenance.

Suspension and closing an account

You can cancel at any time. We may suspend or close an account that doesn't pay, breaks these terms, or puts other users or the service at risk. Where reasonable, we'll give notice first and a chance to fix the problem.

Disclaimers

The service is provided "as is." To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Reports, books, and tax figures in the app are tools, not legal, accounting, or tax advice.

Limit of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Indemnity

You'll defend and hold us harmless from claims arising from your use of the service, the content you send through it, or your breaking these terms or the law, including messaging and consent laws.

Changes to these terms

We may update these terms. We'll post changes here and tell account owners about important ones at least 30 days before they take effect. Using the app after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Georgia, USA, and disputes will be handled in the courts located in Georgia.
